GENERAL CONDITIONS OF USE
Welcome to HYDROGENYX. Access and use of the hydrogenyx.fr site (the “Site”) implies full acceptance of these General Conditions of Use.
1. Purpose. These T&Cs govern the use of the Site published by HYDROGENYX. By browsing the Site, the user acknowledges having read and accepted them.
2. Access to the Site. The Site is accessible free of charge to any user with Internet access. All costs relating to access (equipment, connection) are the responsibility of the user. HYDROGENYX strives to ensure access to the Site 7 days a week but cannot be held responsible for unavailability, in particular for maintenance, updates or cases of force majeure.
3. Intellectual property. All content of the Site (texts, images, logos, “HYDROGENYX” brand, graphics, structure) is protected by intellectual property law and remains the exclusive property of HYDROGENYX or its partners. Any reproduction, representation or exploitation, total or partial, without prior written authorization is prohibited.
4. Accounts receivable. The user who creates an account undertakes to provide accurate information and to preserve the confidentiality of their identifiers. He is responsible for any activity carried out from his account.
5. Personal data. The processing of personal data is described in the Privacy Policy, in accordance with the GDPR.
6. Liability. The information published on the Site is for informational purposes only. HYDROGENYX products are not medical devices and do not replace medical advice. HYDROGENYX cannot be held responsible for non-compliant use of the products.
7. External links. The Site may contain links to third party sites, over which HYDROGENYX exercises no control and declines all responsibility for their content.
8. Modification. HYDROGENYX reserves the right to modify these T&Cs at any time. The applicable version is the one online at the time of consultation.
9. Applicable law. These T&Cs are subject to French law. Any dispute falls under the jurisdiction of the French courts, subject to the protective rules applicable to consumers.
GENERAL CONDITIONS OF SALE
Article 1 — Purpose. These General Terms and Conditions govern the sales of products made on hydrogenyx.fr between HYDROGENYX (the “Seller”) and any non-professional customer (the “Customer”).
Article 2 — Products. The products offered are described with the greatest possible accuracy. The photographs have no contractual value. The products are offered while stocks last.
Article 3 — Price. Prices are indicated in euros, all taxes included (TTC), excluding delivery costs specified before validation of the order. HYDROGENYX reserves the right to modify its prices at any time, it being understood that the applicable price is that in effect at the time of the order.
Article 4 — Order. The Customer validates his order after checking the contents of his basket. Validation constitutes acceptance of these General Terms and Conditions. A confirmation email summarizes the order.
Article 5 — Payment. Payment is made online using the methods offered at the time of ordering. The transaction is secure. The order is only final after actual receipt.
Article 6 — Delivery. The products are delivered to the address indicated by the Customer. Delivery times are provided for information only (Standard 6 to 10 working days / Express 4 to 8 working days). HYDROGENYX cannot be held responsible for delays attributable to the carrier or a case of force majeure.
Article 7 — Right of withdrawal. In accordance with articles L221-18 et seq. of the Consumer Code, the Customer has a period of 14 days from receipt of the products to exercise his right of withdrawal, without having to justify his decision. To exercise it, simply write to contact@hydrogenyx.fr. Products must be returned complete, in their original condition. Return costs are the responsibility of the Customer, unless the product is non-compliant or defective. Reimbursement occurs within 14 days following recovery of the products or proof of shipment.
Legal exclusions: gift cards and unsealed products that cannot be returned for hygiene reasons are not subject to the right of withdrawal (art. L221-28 of the Consumer Code).
Article 8 — Legal guarantees. Independently of any commercial guarantee, the Customer benefits from the legal guarantee of conformity (art. L217-3 et seq. of the Consumer Code) and the guarantee against hidden defects (art. 1641 et seq. of the Civil Code). The Customer can decide to implement the guarantee of conformity and then has 2 years from delivery of the goods.
Article 9 — Commercial guarantee and returns. HYDROGENYX offers a 5-year commercial guarantee on the SPE/PEM cell (free replacement if the device no longer produces correctly enriched water, checked with DPD reagent) and a 60-day “satisfied or refunded” guarantee, under the conditions detailed on the Guarantee page. For any returns, the Customer contacts contact@hydrogenyx.fr to obtain the address and return methods.
Article 10 — Liability. HYDROGENYX products are well-being products; they do not constitute medical devices and cannot replace medical advice or treatment.
Article 11 — Personal data. See the Privacy Policy (GDPR compliant).
Article 12 — Applicable law and disputes. These General Terms and Conditions are subject to French law. In the event of a dispute, the Customer may have free recourse to a consumer mediator before any legal action. In the absence of an amicable resolution, the French courts have jurisdiction.
